By accessing or using DreamNeighborhood (the “Service”), you agree to be bound by this User Agreement (the “Agreement”). If you do not agree with any part of this Agreement, you must not use the Service.
DreamNeighborhood, provided by MotorMouth Corp., offers data-driven insights about neighborhoods, including information sourced from public datasets such as the U.S. Census Bureau, to help individual end users (e.g., homebuyers, renters) evaluate potential places to live. The Service includes features like the “Desirability Index,” which allows end users to customize neighborhood preferences based on various criteria, and access to demographic data (e.g., race and ethnicity statistics) for informational purposes. These features are intended solely for personal, non-commercial use by individual end users and are not available to real estate agents, brokers, or other housing professionals. MotorMouth Corp. is committed to promoting fair, equitable, and non-discriminatory housing practices in compliance with the U.S. Fair Housing Act (42 U.S.C. § 3601 et seq.), Florida’s Fair Housing Act, and all applicable federal, state, and local laws.
The Fair Housing Act (FHA) prohibits discrimination in housing based on race, color, religion, sex, national origin, familial status, or disability. DreamNeighborhood is designed to support lawful and ethical housing decisions by individual end users. By using the Service, you agree to:
- Use the Service Lawfully: You will not use DreamNeighborhood to make housing decisions that discriminate against individuals or groups based on protected characteristics under the FHA or other applicable laws.
- Acknowledge FHA Obligations: Access to demographic data (e.g., race and ethnicity statistics from the U.S. Census Bureau) is provided exclusively to end users for informational purposes only, to promote understanding of community diversity. You agree to use this data solely in a manner consistent with the FHA and not to exclude or prefer neighborhoods based on protected characteristics.
- Complete Fair Housing Training: Before accessing demographic data or the Desirability Index, you must complete a brief educational module on the FHA and fair housing principles, which outlines your legal and ethical responsibilities as an individual home seeker.
The Desirability Index is available exclusively to individual end users for personal, non-commercial housing decisions and is not intended for use by real estate agents, brokers, or other housing professionals. To ensure compliance with fair housing laws, you agree to:
- Certify End-User Status: You certify that you are an individual home seeker and not acting as or on behalf of a real estate professional. Use of the Index for commercial or professional purposes requires prior written authorization from MotorMouth Corp.
- Select Non-Discriminatory Criteria: You will not use the Desirability Index to prioritize or exclude neighborhoods based on race, color, religion, sex, national origin, familial status, or disability. The Index excludes race and ethnicity as selectable criteria to prevent discrimination, and any criteria that indirectly facilitate discrimination (e.g., proxies for protected characteristics) are prohibited.
- Holistic Evaluation: You must select a minimum of 10 criteria from the available 38 to ensure a balanced and comprehensive evaluation of neighborhoods, reducing the risk of biased decision-making.
- Acknowledge Limitations: The Desirability Index is a tool for informational purposes and does not constitute professional real estate advice. You are responsible for verifying all data and consulting with licensed professionals before making housing decisions.
Demographic data, such as race and ethnicity statistics from the U.S. Census Bureau, is available only to individual end users who complete the required FHA training module. This data is provided for educational purposes to promote awareness of community diversity. You agree to:
- Use Data Lawfully: You will not use demographic data to make housing decisions that violate the FHA, such as excluding or preferring neighborhoods based on race or ethnicity.
- Acknowledge Restrictions: Access to demographic data is restricted to end users and prohibited for real estate agents, brokers, or other housing professionals. Misrepresentation of your status may result in termination of access.
You agree not to use the Service for any purpose that:
- Violates the FHA, Florida’s Fair Housing Act, or any other federal, state, or local fair housing laws.
- Facilitates “steering” (directing yourself or others toward or away from neighborhoods based on protected characteristics), redlining, or other discriminatory practices, whether for personal or other purposes.
- Publishes, transmits, or generates statements, advertisements, or notices that indicate a preference, limitation, or discrimination based on protected characteristics.
- Misrepresents housing availability or conditions based on protected characteristics.
- Involves commercial or professional use of the Desirability Index or demographic data by real estate agents, brokers, or other housing professionals without authorization.
- Harms the reputation of MotorMouth Corp. or undermines its commitment to fair housing.
- Accuracy of Information: You are responsible for ensuring that any data or preferences you input into the Service are accurate and lawful.
- End-User Certification: You must certify during onboarding at www.dreamneighborhood.com that you are an individual end user and not a real estate professional. Misrepresentation of your status may result in immediate termination of access.
- Compliance Monitoring: MotorMouth Corp. reserves the right to monitor user interactions with the Service to detect and prevent misuse, including patterns that suggest discriminatory behavior. We may suspend or terminate your access if we suspect a violation of this Agreement.
- Reporting Misuse: If you become aware of any misuse of the Service that violates fair housing laws, you agree to report it to us immediately at legaldepartment@motormouth.io or by calling +1 (424) 484-1940.
- Public Data: The Service uses publicly available data from sources like the U.S. Census Bureau and Wikidata. MotorMouth Corp. does not guarantee the accuracy, completeness, or timeliness of this data.
- User Data: Any personal information you provide is subject to our Privacy Policy, available at www.dreamneighborhood.com/privacy. We may log your interactions with the Service to ensure compliance with this Agreement and applicable laws.
- No Sharing for Discriminatory Purposes: MotorMouth Corp. will not share user-generated data or preferences with third parties in a manner that facilitates discrimination.
- Informational Purposes Only: The Service, including demographic data and the Desirability Index, is provided for informational purposes only. It is not a substitute for professional real estate, legal, or financial advice.
- No Endorsement of Discrimination: MotorMouth Corp. does not endorse or facilitate discriminatory housing practices. Any misuse of the Service to violate fair housing laws is solely the responsibility of the user.
- Third-Party Data: While we strive to provide accurate data, we are not responsible for errors or omissions in third-party data sources.
MotorMouth Corp. reserves the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated this Agreement, engaged in discriminatory practices, or otherwise misused the Service. Upon termination, you must cease all use of the Service.
You agree to indemnify, defend, and hold harmless MotorMouth Corp., its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, violation of this Agreement, or violation of any federal, state, or local laws, including the FHA.
To the fullest extent permitted by law, MotorMouth Corp. shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Service, including any decisions made based on the Service’s data or features. You use the Service at your own risk.
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising under this Agreement shall be resolved in the state or federal courts located in Martin County, Florida.
MotorMouth Corp. may update this Agreement from time to time. We will notify you of material changes via email or through the Service at www.dreamneighborhood.com. Your continued use of the Service after such changes constitutes your acceptance of the updated Agreement.
