Welcome to DreamNeighborhood, a mobile web application operated by MotorMouth Corp. at www.dreamneighborhood.com, designed to provide neighborhood insights to assist real estate professionals (e.g., agents, brokers, or other housing professionals) in supporting their clients’ housing decisions. By accessing or using DreamNeighborhood (the “Service”) as a real estate professional, you agree to be bound by this Real Estate Professional Agreement (the “Agreement”). If you do not agree with any part of this Agreement, you must not use the Service.

1. Purpose of DreamNeighborhood

DreamNeighborhood, provided by MotorMouth Corp., offers data-driven insights about neighborhoods, including information sourced from public datasets such as the U.S. Census Bureau, to help real estate professionals provide lawful and ethical advice to clients. The Service provides access to neutral metrics (e.g., school ratings, crime statistics) but does not include demographic data (e.g., race, ethnicity, or religious affiliation) or the Desirability Index, which are reserved for individual end users. MotorMouth Corp. is committed to promoting fair, equitable, and non-discriminatory housing practices in compliance with the U.S. Fair Housing Act (42 U.S.C. § 3601 et seq.), Florida’s Fair Housing Act, the National Association of Realtors’ Code of Ethics, and all applicable federal, state, and local laws.

2. Compliance with Fair Housing Laws

The Fair Housing Act (FHA) prohibits discrimination in housing based on race, color, religion, sex, national origin, familial status, or disability. As a real estate professional, you are subject to heightened legal and ethical obligations to avoid discriminatory practices, including steering or making statements that indicate a preference based on protected characteristics. By using the Service, you agree to:

• Use the Service Lawfully: You will not use DreamNeighborhood to make or facilitate housing decisions that discriminate against individuals or groups based on protected characteristics under the FHA or other applicable laws.
• Acknowledge Professional Obligations: You will comply with all applicable fair housing laws and professional standards, including the National Association of Realtors’ Code of Ethics (if applicable), when using the Service to advise clients.
• No Access to Restricted Data: The Service does not provide access to demographic data (e.g., race, ethnicity, or religious affiliation) or the Desirability Index to prevent misuse that could violate fair housing laws.

3. Access to Neutral Metrics

The Service provides real estate professionals with access to neutral, FHA-compliant data to support client advising, including:

• School district ratings.
• Crime statistics.
• Economic indicators (e.g., median home prices, employment rates).
• Amenities (e.g., distance to parks, transit, or grocery stores). You agree to use these metrics solely for lawful, non-discriminatory purposes and to verify all data before advising clients.

4. Prohibited Uses

You agree not to use the Service for any purpose that:

• Violates the FHA, Florida’s Fair Housing Act, the National Association of Realtors’ Code of Ethics, or any other federal, state, or local fair housing laws.
• Facilitates “steering” (directing clients toward or away from neighborhoods based on protected characteristics), redlining, or other discriminatory practices.
• Publishes, transmits, or generates statements, advertisements, or notices that indicate a preference, limitation, or discrimination based on protected characteristics.
• Misrepresents housing availability or conditions based on protected characteristics.
• Attempts to access or use demographic data or the Desirability Index, which are restricted to end users.
• Harms the reputation of MotorMouth Corp. or undermines its commitment to fair housing.

5. User Responsibilities

• Accuracy of Information: You are responsible for ensuring that any data or preferences you input into the Service are accurate and lawful.
• Professional Certification: You must certify during onboarding at www.dreamneighborhood.com that you are a real estate professional (e.g., agent, broker, or other housing professional). Misrepresentation of your status may result in immediate termination of access.
• Compliance Monitoring: MotorMouth Corp. reserves the right to monitor user interactions with the Service to detect and prevent misuse, including patterns that suggest discriminatory behavior. We may suspend or terminate your access if we suspect a violation of this Agreement.
• Reporting Misuse: If you become aware of any misuse of the Service that violates fair housing laws, you agree to report it to us immediately at legaldepartment@motormouth.io or by calling +1 (424) 484-1940.

6. Data Usage and Privacy

• Public Data: The Service uses publicly available data from sources like the U.S. Census Bureau and Wikidata, excluding demographic data related to protected characteristics. MotorMouth Corp. does not guarantee the accuracy, completeness, or timeliness of this data.
• User Data: Any personal information you provide is subject to our Privacy Policy, available at www.dreamneighborhood.com/privacy. We may log your interactions with the Service to ensure compliance with this Agreement and applicable laws.
• No Sharing for Discriminatory Purposes: MotorMouth Corp. will not share user-generated data or preferences with third parties in a manner that facilitates discrimination.

7. Disclaimers

• Informational Purposes Only: The Service is provided for informational purposes only and is not a substitute for professional real estate, legal, or financial advice.
• No Endorsement of Discrimination: MotorMouth Corp. does not endorse or facilitate discriminatory housing practices. Any misuse of the Service to violate fair housing laws is solely the responsibility of the user.
• Third-Party Data: While we strive to provide accurate data, we are not responsible for errors or omissions in third-party data sources.

8. Termination

MotorMouth Corp. reserves the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated this Agreement, engaged in discriminatory practices, or otherwise misused the Service. Upon termination, you must cease all use of the Service.

9. Indemnification

You agree to indemnify, defend, and hold harmless MotorMouth Corp., its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, violation of this Agreement, or violation of any federal, state, or local laws, including the FHA.

10. Limitation of Liability

To the fullest extent permitted by law, MotorMouth Corp. shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Service, including any decisions made based on the Service’s data. You use the Service at your own risk.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising under this Agreement shall be resolved in the state or federal courts located in Martin County, Florida.

12. Changes to This Agreement

MotorMouth Corp. may update this Agreement from time to time. We will notify you of material changes via email or through the Service at www.dreamneighborhood.com. Your continued use of the Service after such changes constitutes your acceptance of the updated Agreement.

14. Acknowledgment

By clicking “I Agree” or using the Service at www.dreamneighborhood.com, you acknowledge that you have read, understood, and agree to be bound by this Agreement, including your obligations under the U.S. Fair Housing Act, Florida’s fair housing laws, and applicable professional standards. You further acknowledge that misuse of the Service to discriminate in housing decisions may result in legal consequences, including civil and criminal penalties under applicable laws.
