Dream Neighborhood and Dream Neighborhood Schools
MotorMouth Corp.
Dream Neighborhood and Dream Neighborhood Schools (together, the “Service”) are operated by MotorMouth Corp. (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Service, whether you are an End User or a Partner.
The Service includes two products:
- School Explorer (Dream Neighborhood Schools), available at www.dreamneighborhoodschools.com. School Explorer is free.
- Neighborhood Explorer (Dream Neighborhood), available at app.dreamneighborhood.com and related pages at www.dreamneighborhood.com. Neighborhood Explorer is offered on a paid-subscription basis.
Both products may be used on the Company’s websites and may be installed on a Partner’s website (including a real estate website) as a popup or an embedded explorer, using a one-line installation script.
By accessing or using the Service (including through a popup or embedded explorer), you agree to these Terms. If you do not agree, you must not use the Service.
1. Fair Housing Compliance (Applies to All Users)
The Company is fully committed to compliance with the U.S. Fair Housing Act (42 U.S.C. § 3601 et seq.), Florida’s Fair Housing Act, and all applicable federal, state, and local fair housing laws, as well as any other laws related to housing, education data, privacy, and anti-discrimination. Discrimination in housing based on race, color, religion, sex, national origin, familial status, disability, or any other protected characteristic is strictly prohibited.
You agree that you will not use the Service — including any neighborhood insights, school data, Diversity Index, Desirability Index, ratings, or demographic information — to engage in steering, redlining, blockbusting, discriminatory advertising, or any other practice that violates fair housing laws or other applicable laws.
Detailed racial, gender, and other protected-class demographic data:
- Full race, gender, and other protected-class breakdowns for schools are shown only on school listings on the Dream Neighborhood Schools website (www.dreamneighborhoodschools.com), and only after the visitor agrees to the Company’s fair housing terms (an on-site acknowledgment, in the same general model used by sites such as GreatSchools.org, Niche.com, and NCES).
- That detailed data is never shown on a realtor or other third-party webpage, whether in a popup or an embed, for Neighborhood Explorer or School Explorer.
- On a Partner website, a popup or embedded explorer may show only a Limited view. The Limited view may include a Diversity Index. It does not include full race, gender, or other protected-class breakdowns.
End Users: On the Dream Neighborhood Schools website, you must agree to the fair housing terms before accessing detailed school race or other protected-class demographic data. You agree to use such data only for lawful, non-discriminatory personal decisions regarding housing and schools. You agree not to use this information to exclude or prefer neighborhoods or housing based on protected characteristics in violation of law.
Partners: You must maintain compliance with all applicable fair housing laws and other laws when using the Service, installing a popup or embedded explorer, or displaying Service data to your clients or website visitors. You are responsible for ensuring that any use of the Service by you or your visitors does not violate fair housing or other laws. You must not bypass, disable, or circumvent the realtor-page suppression of detailed racial or other protected-class data, and you must not display that detailed data on your websites. The Limited view (including any Diversity Index) and the automatic suppression of detailed protected-class data are provided to help with compliance, but Partners remain fully responsible for their use of the Service and any additional context they provide. Misuse may result in immediate termination of access and may be reported to relevant authorities.
2. Definitions
End User: An individual using the Service for personal, non-commercial purposes (for example, a homebuyer, renter, or person researching schools).
Partner: A real estate professional, broker, brokerage, website operator, or other customer who installs or operates a popup or embedded explorer on a website, or who holds a Neighborhood Explorer subscription.
Limited view: The popup or embedded explorer as it appears on a Partner or other third-party website. The Limited view may include a Diversity Index and other non-restricted information. It does not include full race, gender, or other protected-class breakdowns.
3. The Service
The Service provides neighborhood insights and school information for informational purposes only. It is not a substitute for professional real estate, legal, educational, or financial advice. You are solely responsible for verifying all information independently before making any housing, school, or other decisions.
School data displayed through the Service is drawn from publicly available sources and is provided for informational purposes.
Both products may be installed with one line of JavaScript as a popup or as an embedded explorer on a Partner website. An embedded explorer is designed to fail silently: if it does not load or encounters an error, it is intended not to disrupt the Partner’s webpage. The Company does not warrant that a popup or embed will load on every site or at all times.
The current Partner installation set is the popup and the embedded explorer only.
4. Terms Specific to End Users
End Users may access neighborhood insights, school data, the Diversity Index, the Desirability Index, and — on the Dream Neighborhood Schools website only, after agreeing to the fair housing terms — detailed school demographic data, solely for personal, educational, and non-discriminatory purposes.
School Explorer is free. Use of Neighborhood Explorer features that require a paid subscription is subject to Section 6.
5. Terms Specific to Partners
Partners are granted a limited, revocable, non-exclusive, non-transferable license to install and display the Company’s popup and embedded explorers using the Company’s one-line installation code. This license does not include any right to display full race, gender, or other protected-class breakdowns on a Partner or other third-party website.
Partners must:
- Obtain necessary consents.
- Display required links and notices.
- Comply with fair housing laws.
- Not bypass suppression of restricted demographic fields.
- Not modify or redistribute without authorization.
The Company may suspend or terminate a Partner’s license immediately for misuse, including any attempt to show detailed racial or other protected-class data on a realtor or other third-party webpage.
6. Fees and Subscriptions
School Explorer is free. Neighborhood Explorer is a paid product. You may cancel a paid Neighborhood Explorer subscription at any time. These Terms do not describe specific prices; those are presented at subscribe time.
7. Prohibited Uses
You may not use the Service to:
- Violate any fair housing law or engage in discriminatory housing practices.
- Display full race, gender, or other protected-class breakdowns on a realtor or other third-party webpage.
- Bypass, disable, or circumvent the realtor-page suppression of detailed protected-class data.
- Interfere with fail-silent embeds or otherwise disrupt a Partner’s webpage, or attempt to access restricted features.
- Modify or redistribute the Service or installation code without authorization.
8. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on the Service or sent by email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
9. Disclaimers and Limitation of Liability
The Service is provided “AS IS” and “AS AVAILABLE.” The Company does not warrant the accuracy of neighborhood insights, school data, indexes, or ratings, and does not warrant that a popup or embed will load on every site or at all times. To the fullest extent permitted by law, the Company is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.
10. Indemnification
You agree to indemnify, defend, and hold harmless MotorMouth Corp., its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms, including any violation of fair housing or other laws.
11. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
12. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements.
13. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Martin County, Florida.
